Court Sacks Osun Poly Alumni Exco Over Invalid Election

A state High Court sitting in Ila has nullified the national convention of the the Osun State Polytechnic Iree Alumni Association held on December 7, 2024 and produced the executive led by Yakubu Akeem Adebayo.

The court, presided over by Mrs. Justice G.O. Lawal, held that the convention was conducted in violation of the association’s constitution, and restrained the Osun State Polytechnic, Iree and the Chairman of the Governing Council from recognizing the elected executive.
The judgment was delivered in a suit filed by the claimants, who challenged the validity of the election.

The claimants argued that the notice of convention and election was issued with less than 30 days’ notice, which is contrary to the provisions of the association’s constitution.
In her judgment, “The constitution of the Osun State Polytechnic, Iree Alumni Association is supreme and its provision are binding on all the members of the Association including the 1st to 5th Defendants.
“The issuance of less than 30 days-notice by the 1st to 4th Defendants for holding of National Convention for the purpose of the 5th Defendant to conduct election into the offices of the Alumni Association is illegal, unlawful and outright violation of the constitution of the Osun State Polytechnic, Iree Alumni Association.
“The notice of meeting published in the Daily Times of 18th day of November, 2024 for the holding of National Convention and for the purposes of conducting election into the offices of the Alumni.

“Association slated to hold on the 7th day of December, 2024 is hereby nullified for being inconsistent with the provisions of the constitution of the Alumni Association.
“The Osun State Polytechnic, Iree and Chiarman Governing Council, Osun State, Hon. Diran Ayanbeku are hereby restrained from recognizing any person or officers purported to be elected into the offices of the Osun State Polytechnic Iree Alumni Association at the National Convention of the Association held on the 7th day of December, 2024 as the notice issued by the Association for the convention is inconsistent with the provisions of the constitution of the Association,”.
Reacting to this, the National Publicity Secretary of the association,Adekunle Sikiru (Abacus), in a statement released called for calm saying the leadership of the association will appeal the judgment.
The statement reads,”Following the court judgment on the case of the leadership crisis of the Osun State Polytechnic Iree Alumni Association (OSPAA) delivered by Justice G.O. Lawal of the Osun State High Court Ila, which nullified the National Convention of the Association held on December 7, 2024.
“The leadership of the Association has therefore called on members to remain calm as the Association’s legal team is set to file an appeal and seek a stay of execution, confident in the justness of their cause and the appellate process.
“The Association emphasized on the importance of the right to appeal, as enshrined in the Nigeria Constitution, adding that, following the matter to the Apex court is a right of individual or group as stipulated in bylaws rather than creating unnecessary drama that may affect the progress and development of the Association.

“The Association therefore appealed to members not to panic as the leadership of the Association remains unchanged until Apex Court delivers its verdict.
“The constitution of the Association and that of Nigeria allows individual or group to counter any unfavorable judgement delivered in any lower court till apex court, there is no going back in the appeal court process as arrangements have been concluded to file the appeal application instead of creating unnecessary arguments on social media.

“We are appealing to all our members to remain calm as leadership is still intact until final judgement is given in the appeal court” the statement said.
